Appeals Court Attorneys
Our appeals court attorneys have helped shape the current state of Idaho law with their active appellate practice. We have been responsible for delineating and strengthening the compulsive nature of the notice requirement of the Idaho Tort Claims Act, for shaping the nature of herd district law, and for numerous favorable appellate rulings regarding Idaho’s stringent expert witness foundation requirements for plaintiffs in medical malpractice litigation. Most recently, our firm’s appeals court attorneys have been responsible for obtaining the second appellate decision regarding the issue of apparent authority in Idaho, and the conciliation from the Idaho Supreme Court of a mechanism for hospitals to avoid liability under a theory of apparent agency. We have handled appeals from a variety of motion practice, but most notably from summary judgment rulings and directed verdicts, as well as evidentiary rulings and post-trial motion practice. We understand the importance of building a good record from which to initiate or defend an appellate action. We have defended appeals, as well as served as counsel for the appellate, so we understand both roles of this important work to establish the law in the state of Idaho.
